RENT REVIEW/LEASE RENEWALS

Many leases of commercial property contain provision for rent reviews allowing the landlord the opportunity to adjust the rental to reflect market conditions at the relevant review date. Correct interpretation of the terms within the lease are crucial.

At the end of the contractual term the landlord and tenant may or may not desire to renew the lease. In either eventuality, there are strict provisions which require to be implemented under the terms of the Landlord and Tenant Act 1954 Part II.

SCHEDULES OF CONDITION/DILAPIDATION

A Full Repairing and Insuring lease usually requires the tenant to keep premises maintained in good and tenantable condition. This may also imply that the tenant might first be required to put the premises into good repair.

A Schedule of Condition recording the state of the premises at the commencement of the term may serve to limit the tenant's repairing liability, saving thousands of pounds.

Where leasehold premises are being vacated, a Schedule of Dilapidations may be required by the landlord seeking rectification or compensation for any outstanding repairs at the end of the term.

BB&J can undertake to act on behalf of the landlord or the tenant in the preparation of a suitable settlement where disputes may arise.
